LOCAL TRUCKS (“we”, “us”, or “our”) operates the website www.localtrucks.au and provides express freight and logistic services (the “Services”). This Terms of Service agreement (the “Terms”) governs your access to and use of the website and our Services. By using the website or engaging our Services, you agree to be bound by these Terms.

1. Definitions

  • “Customer,” “you,” or “your” means a person or entity who uses the website or engages our Services.
  • “Booking” means a request to arrange transport of goods or shipments through LOCAL TRUCKS.
  • “Shipment” means goods or items transported under a Booking.
  • “Carrier” means any third-party transport provider engaged by LOCAL TRUCKS to move shipments.
  • “Agreement” means these Terms, the Privacy Policy, and any other policies or service descriptions referenced herein.
  • “Personal Information” has the meaning given to it in applicable privacy laws and is governed by our Privacy Policy.

2. Acceptance of Terms

  • By accessing or using www.localtrucks.au or our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
  • If you do not agree with any part of the Terms, you must not use the website or engage our Services.

4. Scope of Services

  • LOCAL TRUCKS provides reliable and efficient express freight transport solutions in Australia (and as otherwise agreed). We strive to deliver shipments on time, in line with the Service Level described in the applicable Booking or quote.
  • All Services are subject to availability, regulatory requirements, and the terms of any agreements with carriers or third-party service providers.
  • Our tagline “EXPRESS FREIGHT SERVICES” and statements such as “On Time Since 2014” reflect our commitment to timeliness and reliability, but do not constitute a guarantee of delivery times or service outcomes.

5. Use of the Website

  • You must be at least 18 years old to use the site (or as otherwise allowed by applicable law).
  • You agree not to use the site for unlawful purposes or in a way that could damage, disable, overburden, or degrade the site or interfere with other users.
  • You are responsible for maintaining the confidentiality of any account credentials and for all activity that occurs under your account.

6. Booking, Shipments, and Service Levels

  • Booking Process: To arrange a Shipment, you may request a quote or place a Booking through the site or via our contact channels. A Booking is an offer to engage our Services, subject to acceptance by LOCAL TRUCKS.
  • Acceptance and Confirmation: A Booking is only binding once we issue a confirmation. We may refuse or cancel a Booking at our discretion, including due to security, regulatory, or operational reasons.
  • Service Levels: Any Service Level or delivery estimates provided are best estimates and may be affected by factors beyond our control (traffic, weather, regulatory delays, procedures at pick-up/delivery points, etc.).
  • Documentation: You must provide accurate and complete information relevant to the Shipment (including origin, destination, items, dimensions, weight, hazardous classifications, and special handling requirements). False or incomplete information may affect service eligibility or result in additional charges.
  • Risk and Title: The risk of loss or damage to the Shipment passes to the Customer upon pickup by LOCAL TRUCKS or upon delivery to the designated recipient, depending on the arrangements stated in the Booking or applicable bill of lading. Title to Goods remains with the Customer unless otherwise agreed.

7. Pricing, Quotes, and Payments

  • Quotes: Any price quote is an estimate based on the information provided and is subject to change with changes in scope, service levels, or other factors. A formal Booking confirmation will fix the price at the time of acceptance.
  • Fees and Taxes: Prices are exclusive of any applicable taxes (including GST where required). You will be invoiced for the Services as described in the Booking or agreement.
  • Payment Terms: Unless otherwise agreed, payment is due within the period stated on the invoice (commonly net 14 days). Late payments may incur interest or administrative charges as permitted by law.
  • Payment Methods: We may accept payments via bank transfer, credit/debit card, or other methods described in the Booking or on the invoice.
  • Disputes: Any billing disputes must be raised within a reasonable period after receipt of the invoice; unresolved disputes do not suspend payment obligations for undisputed amounts.

8. Cancellations, Modifications, and Refunds

  • Cancellations: You may cancel a Booking in accordance with the cancellation policy provided at the time of Booking. Cancellations may incur fees, as specified in the Booking terms.
  • Modifications: Any changes to a Booking (origins, destinations, shipments, service level) may be subject to additional charges and require re-quotation.
  • Refunds: Refund eligibility will be determined by the nature of the Booking and the reason for cancellation. Any refunds will be processed per our refund policy and applicable law.

9. Insurance, Liability, and Claims

  • Insurance: We recommend obtaining appropriate insurance coverage for shipments. Insurance may be arranged as part of the Service or through a separate policy; terms and coverage will be defined in the applicable booking or policy.
  • Carrier Liability: Our liability for loss or damage to shipments is subject to applicable law, the terms of the bill of lading, and any insurance coverage selected. Our maximum liability (to the extent permitted by law) will be the lesser of the actual value of the shipment or the amount paid for the Services related to the shipment, except in cases of gross negligence or willful misconduct.
  • Excluded Losses: We are not liable for indirect, consequential, incidental, punitive, or exemplary damages except as required by law.
  • Claims: Any claim for loss or damage must be made in accordance with the claim process described in the Booking or policy and within the applicable limitation periods.

10. Risk Management and Compliance

  • We will comply with all applicable Australian laws and regulations governing transportation, handling, and security of shipments.
  • You must comply with all applicable laws, regulations, and restrictions related to the goods being shipped (including hazardous materials, perishable goods, and constrained items).
  • You are responsible for obtaining any necessary licenses, permissions, or permits for shipments.

11. Intellectual Property

  • The website and all content (text, graphics, logos, images, software, and other materials) are protected by intellectual property laws and owned or licensed by LOCAL TRUCKS.
  • You may access and use the site for personal or business purposes in accordance with these Terms, but you may not copy, reproduce, distribute, modify, or create derivative works without our prior written consent, except as permitted by law or for viewing in the normal course of use.
  • Any third-party trademarks or content displayed on the site are the property of their respective owners.

12. Privacy and Data Security

  • Our Privacy Policy governs the collection, use, storage, and disclosure of Personal Information. By using the site or Services, you consent to our handling of your Personal Information as described in the Privacy Policy.

  • We disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the extent permitted by law.

16. Indemnity

You agree to indemnify, defend, and hold harmless LOCAL TRUCKS and its officers, employees, agents, affiliates, and contractors from and against any claims, losses, damages, liabilities, costs, and expenses arising out of your use of the site or Services, violation of these Terms, or infringement of any rights of a third party.


17. Force Majeure

Neither party is liable for failures or delays caused by events beyond reasonable control (e.g., natural disasters, war, acts of government, labor disputes, network or power outages).


18. Notifiable Data Breaches and Security

  • We will comply with applicable data breach notification laws (e.g., Notifiable Data Breaches scheme in Australia) and the OAIC obligations where required.

19. Governing Law and Jurisdiction

  • These Terms and any disputes arising out of or in connection with them shall be governed by the laws of Queensland, Australia.
  • Any disputes not resolved amicably will be brought before the courts of Queensland, Australia, to the extent allowed by law.

20. Dispute Resolution

  • We encourage informal resolution of disputes. If a dispute cannot be resolved informally, the parties may pursue mediation or arbitration as agreed between the parties or as required by law.
  • Nothing in these Terms prevents you from seeking remedies available under consumer protection laws or other rights you may have under applicable law.

22. Assignment and Subcontracting

  • LOCAL TRUCKS may assign or subcontract any rights or obligations under these Terms without your consent, provided that the assignee agrees to be bound by equivalent obligations.
  • You may not assign your rights or delegate your duties under these Terms without our prior written consent.

23. Entire Agreement

  • These Terms, together with our Privacy Policy and any Booking terms or service descriptions referenced herein, constitute the entire agreement between you and LOCAL TRUCKS regarding the Services and supersede all prior agreements or understandings.

24. Severability

  • If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

25. Waiver

  • Failure to enforce any provision of these Terms does not constitute a waiver of that or any other provision.

26. Survival

  • Provisions that by their nature should survive termination (e.g., ownership, liability, indemnity, dispute resolution) will remain in effect after termination.
